Terms of Service

The short version
- Nothing before the deposit costs you anything, and nothing before the deposit obligates you.
- The price is $3,500 flat. There is no hourly rate and no monthly fee.
- When the site is paid for, the code is yours. So is your domain, all the way through.
- Our free tools are honest estimates, not promises. Only check a site you are allowed to check.
That is the deal in four lines. The detail is below if you want it.
Agreeing to these terms
By using this website, our free tools, or our design services, you agree to what is written here. If you do not agree, please do not use them. We are Aloha Media Websites, 839 E Winding Creek Dr, Suite 202, Eagle, ID 83616.
How we actually work
Most agencies send a proposal, sign a contract, take a deposit, and then start building. We do not. Here is the real sequence, and it is the one these terms are written around:
- You tell us about your business, or we pick you and reach out.
- We research, write, design and hand-code a real working homepage. This is our own time and our own cost. There is no contract at this point and you owe nothing.
- We show it to you. One round of changes is included free.
- If the direction is right, you place the deposit and we build the rest of the site.
- The rest of your site is built and shown to you within 24 hours of that deposit, and one round of changes is included.
- The remaining $2,000 is due before the site goes live, which is normally about a week from the deposit.
Up to step 5 you can walk away at any time, for any reason or none, and you will not be invoiced. If we build a site you do not want, that cost is ours. It is how we find clients instead of spending money on selling.
Going live on schedule assumes we already have what we need to point your domain and set up hosting. We sort that out with you before the deposit, not after. A photography session or an online store can add time to the build, and we tell you that up front rather than quietly missing a date.
Price
- $3,500 flat for the full custom site. Page count does not change it.
- $1,500 when you approve the free homepage. This is what starts the rest of the build.
- $2,000 due before the site goes live, normally about a week after the deposit, payable on that schedule unless we agree otherwise in writing.
- An online store is the one add-on that costs extra, at $1,500. We quote it before we build it, never after.
- A professional photo shoot at your business and online booking setup are included, not extras.
- There is no hourly rate. We do not bill by the hour for anything, at any stage.
- There is no monthly fee from us. First-year hosting is covered in the price.
- All amounts are in US dollars. Any sales tax that applies is added on top.
If the balance is not paid within 30 days of going live, we may take the site offline until it is settled. We will email you first, more than once, before that ever happens.
Changes and extra work
One round of changes on the free build is included. Once you have approved the finished site, changes to what was agreed become new work, and we will quote a flat price for them before starting. We will never do extra work and then send you a surprise invoice for it.
Small content updates for the first year after launch are included in the price. That means text edits, swapping a photo, adding an hour to your hours. It does not mean new pages, new features, or a redesign.
Who owns what
Your material stays yours. Photos, logos, copy, and anything else you hand us remains your property. You confirm you have the right to give it to us.
The site becomes yours when it is paid for. Once the balance is settled you own the design and all the code we wrote for you, outright, forever. You can move it to any host you like. There is no license to renew and nothing that stops working if you leave.
Your domain is yours the entire time. You buy it and it stays in your name. We only ever help you point it.
Bits that belong to other people. Fonts, stock imagery, icons and any third-party service we plug in carry their own licenses, and those licenses continue to apply to your site.
Our portfolio. We may show finished work on this site and in our own marketing. If you would rather we did not, tell us and we will not.
What we need from you
- Accurate information about your business
- Access to your domain and hosting when it is time to go live
- Feedback in a reasonable time, so the project does not stall
- The right to use anything you send us
- Payment on the schedule above
If a project goes quiet on your end for more than 60 days after we have shown you the finished site, we may close it out. Picking it back up later is fine and we will not charge you for the gap.
Stopping
- Before the deposit: either of us can stop, no cost, no explanation needed.
- After the deposit and before the site is live: we refund the deposit less the work already done at that point, and we tell you plainly what that covers.
- Once the site is live: the deposit is not refundable, and the balance is owed.
- If we are the ones who stop, you pay nothing further and you keep anything you have already paid for.
After launch, and the marketing handoff
We build sites. We do not sell monthly SEO or run advertising. Once your site is live we can introduce you to Integrity Marketing Services for ongoing SEO, ads, and content. That is optional, it is never required to launch, they set and bill their own prices, and we do not mark them up. Because they are a separate company, their work is between you and them and we are not responsible for it.
What we do not promise about search rankings
We build sites to load fast and to be read properly by search engines, and we include the technical groundwork for that in every build. What nobody can promise, including us, is a particular position in Google for a particular search. Search results depend on competitors, on how long a site has been around, on reviews, and on rules Google changes without telling anyone. Treat any specific ranking guarantee, from us or from anyone else, as a warning sign.
The free tools
The Website Checkup, the cost calculator and the lost-leads calculator are free to use, including for businesses that never become clients. Some rules:
- Only submit a website you own or have permission to check. The tool reads the public version of a page the same way a search engine does, but it is on you to have the right to run it.
- Results are an automated opinion, not a professional audit or a guarantee. A high score does not mean a site is safe, legal or profitable, and a low score does not mean it is broken.
- The calculators are estimates built on assumptions you choose. They are for thinking with, not for accounting.
- Do not run these tools automatically or at volume, and do not use them to build a competing product. We rate-limit them, and we can block abuse.
- We may change or retire a tool at any time.
What we do with the information you type into them is covered in our Privacy Policy.
Using this website
When you use this site, you agree not to:
- Use it for anything unlawful
- Try to get into any part of it you were not given access to
- Interfere with how it runs, or scrape it at a volume that affects other visitors
- Copy or republish our writing, design or code without permission
- Submit false information through our forms
Limits of liability
This website and the free tools are provided as they are, without warranties of any kind. We do not promise the site will never go down or never contain an error.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, including lost profits or lost business, arising from this website, the free tools, or our services. For anything we are liable for, our total liability is capped at what you actually paid us for the work in question. If you have not paid us anything, which is the case for everyone using the free tools, that cap is zero.
Nothing here tries to limit liability for fraud, or for anything that cannot legally be limited.
You also agree to cover us for claims that come out of material you gave us, a website address you told us to check, your use of our services, or your breach of these terms.
Which law applies, and everything else
These terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts in Ada County, Idaho. Before anyone files anything, we ask that you call us and try to sort it out first. Most things that look like a dispute are a misunderstanding that a phone call fixes.
If any part of these terms turns out to be unenforceable, the rest still stands. A written project agreement, if we sign one with you, wins over anything on this page where the two disagree. We may update these terms; the date at the top changes when we do, and the version live at the time you engage us is the one that applies to your project.
